Deceptive Marketing

Antelope Valley YAZ (Yasmin) Injury Attorneys

In the YAZ ad campaigns, we see beautiful and happy women who have achieved freedom from PMDD (premenstrual dysphoric disorder) and moderate acne by taking YAZ. We see that those of us who suffer from severe physical and emotional premenstrual symptoms may be able to experience relief from irritability, anxiety, headaches, and numerous other conditions that visit us once a month, whether we like it or not. Who wouldn’t want to experience this relief and have clear skin? According to the marketing campaigns for YAZ, this oral contraceptive goes “beyond birth control” to help women with these issues.

In light of the serious  side effects that many women have experienced after taking YAZ, the question has arisen as to whether these marketing campaigns are deceptive. As a matter of fact, the FDA (Food and Drug Administration) has intervened on three separate occasions in the past 9 years regarding marketing campaigns for YAZ and Yasmin. Following are the main issues that have arisen in regard to potentially deceptive marketing campaigns for YAZ and Yasmin:

  • Misleading information – one of the first Yasmin commercials, titled “Goodbye Kiss” states: “The Yasmin birth control pill uses a different kind of hormone. One that may work with your body chemistry.” In particular, the FDA objected to the statement that Yasmin may work with your body chemistry because oral contraceptives actually work against a woman’s body chemistry by preventing ovulation and therefore pregnancy.

  • Helping with PMS or PMDD? – later marketing commercials for YAZ stated that the pill may help with such symptoms as irritability, moodiness, headaches, and feeling anxious, all symptoms commonly associated with PMS as well as PMDD. These ad campaigns may have been misleading in that they failed to differentiate that YAZ may help with PMDD, not PMS.

  • Minimizing side effects – YAZ and Yasmin campaigns alike have seen much scrutiny over the minimization of the potentially serious side effects associated with these oral contraceptives. With visual distractions and music in the commercials, it may be easy for the average consumer to overlook vital information about these side effects.
